New Privacy Laws Require Valid Consent

Most privacy regulations require a valid consent from individuals for data processing or some other legal need/purpose for processing.

“In order for processing to be lawful, personal data should be processed on the basis of the consent of the data subject concerned or another legitimate basis,” (GDPR, Recital 40). In other words, consent is just one of the legal bases you can use to justify your collection, handling, and/or storage of people’s personal data.

What Is Valid Consent?

In general, consent, by definition, requires:

  • Specific, freely given, informed and explicit indication of an individual’s desire and intent to allow the processing of his/her personal data given by means of a clearly affirmative action or statement.
  • The ability of the entity gathering the information to demonstrate that the individual whose data is being collected has given free and unquestionable consent for his/her information to be processed.
  • Individuals may withdraw their consent any time they choose. Withdrawal of consent will not affect the lawfulness of the processing performed before the consent was withdrawn. Individuals from whom consent is being sought must be informed of this right before his/her consent can be considered valid.
  • Withdrawal of consent should be as easy for the data subject to execute as the giving of consent.

The CCPA is a set of laws giving new rights to California residents, including the right to:

  • Access and delete personal information
  • Select an opt-out option regarding the sale of their personal information
